Terms of Service

1. Acceptance of Terms

By accessing or using the Potty Pal mobile application ("App"), operated by Kinetic Flux, LLC ("we," "us," "our," or "Potty Pal"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

By creating an account, continuing as a guest, or otherwise using the App, you represent and warrant that you meet the eligibility and minimum age requirements set out in Section 3.1. If you do not meet those requirements, you may not use the App.

3.1 Eligibility and Minimum Age

The App is intended for a general audience and is not directed to children. You must be at least 13 years old to create an account or otherwise use the App.

If you are located in the European Economic Area or the United Kingdom, you must be at least 16 years old, or the minimum age of digital consent in your country of residence if that age is lower than 16.

By creating an account, continuing as a guest, or otherwise using the App, you represent and warrant that you meet the applicable minimum age stated above and that you have the legal capacity to enter into these Terms. If you are under the age of majority where you live but meet the applicable minimum age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, or from a user below the applicable minimum age, we will terminate the account and delete the associated information. If you believe a child has provided us with personal information, contact us using the details in Section 17 and we will act promptly.

3.2 Account Creation

To use the App, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials.

3.3 Account Responsibility

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

4.1 Free, Ad-Supported Version

Potty Pal is free to use, and every feature of the App is available in the free version. The free version is supported by advertising (see Section 4.6). An optional subscription removes advertising; it is not required to use any part of the App.

4.2 Subscription Plans

An optional paid subscription removes advertising. Every feature of the App is available to all users, whether free or subscribed; removing ads is the subscription's only effect. Subscription options are:

Prices are subject to change with 30 days notice. Current pricing is always shown in the App Store at the time of purchase.

4.3 Payment Processing

All payments are processed through Apple's App Store. Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period.

4.4 Refunds

Refund requests are handled according to Apple's App Store refund policy. We do not directly process refunds.

4.5 Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period.

4.6 Advertisements

The free version of the App displays advertising served through Google AdMob. Ads are non-personalized and are not based on tracking you across other apps or websites. Subscribing removes all advertising. How advertising data is handled is described in our Privacy Policy.

5. User Content

You retain ownership of all content you submit to the App (dog profiles, photos, activity logs, notes). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the service.

By using the App, you agree that we may collect, anonymize, and aggregate pet activity data (with all personally identifiable information removed) to produce analytics, insights, and recommendations that benefit the broader dog owner community. This anonymized data cannot be traced back to you, your family, or your individual pets. For more details, see our Privacy Policy.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate.

The App and its original content, features, and functionality are owned by Kinetic Flux, LLC and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTTY PAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold Potty Pal and Kinetic Flux, LLC harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

11. Medical Disclaimer

Potty Pal is not a substitute for professional veterinary advice. The App's predictions and recommendations are based on historical data and should not be used as the sole basis for medical decisions. Always consult with a veterinarian for medical concerns about your pet.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that the App automatically collects usage, diagnostic, and crash information so we can operate and improve it. This includes analytics and crash reporting provided by Google Firebase, and our own analytics keyed to a random device identifier generated on your device. This collection begins when the App starts and there is currently no in-app setting to disable it. It is described in full, including what is collected and how long it is kept, under "Usage Information" in our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of these Terms or your use of the App shall be resolved through binding arbitration administered in the State of California in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
